In these Terms and Conditions, users of the Site and/or Services, whether they are subscribers, customers, or casual browsers of the Site, are called 'Users'. Please read these Terms and Conditions before using our website or services. By using or accessing our website and/or services, you agree to be legally bound by these Terms and Conditions and all guidelines and policies incorporated by reference in these Terms. Our website and services is not intended to be used by minors. You must be at least of the age of majority to use our website. 2. Service Fees and Taxes

You are responsible (financially and otherwise) for all activity on your account, including all fees incurred by your activity. Charges and any other fees for the use of this website and/or our services are described on the website, service agreements or any combination thereof. They may change at any time. If you keep using the service after the change, you accept the new charges and fees. Any change to charges and other fees will be applicable to the next billing period in which the change occurs. Some independent carriers, mobile networks, and service areas may carry additional fees not explicitly stated, and will be the responsibility of the user. You are responsible for all taxes applicable to the fees (depending on your geographical location / residence).

Any use of any portion of the Content without the prior written permission of its owner is strictly prohibited. All rights to the website and non-User content are expressly reserved. User Content is user's responsibility. We have no responsibility or liability for it, or for any loss or damage your User Content may cause. We have the absolute discretion, but no obligation, to remove, or edit any User Content, at any time and for any reason.

4. Limited License of the User Content to PrimeContact.

We need the right to use User Content to the extent necessary to operate the website and our services. By uploading/entering User Content to the website, user grants us and our affiliates and subsidiaries a non-exclusive, royalty-free, transferable right to use and modify works from such User Content on the website. We are not required to pay or compensate User for the use of it.

7.1 Message Privacy - The customer acknowledges that message content is transmitted unencrypted and that eavesdropping of phone communications by third parties is possible.

7.2 Delivery - The customer acknowledges that we deliver messages via major telecommunications companies and mobile network providers and can therefore only influence the delivery of the messages within the technical constraints imposed by the abovementioned providers. Messages submitted via our website will be transferred to the addressed recipients provided that the recipient's receiver is switched on and located in an area covered by their subscribed network provider. The customer acknowledges that, depending on the recipient's provider service, it may not be possible to transmit the message to the recipient successfully, particularly if the provider does not support chosen delivery method at all.

7.3 Large Volume Transmission - The customer acknowledges that transmission of large numbers of messages may be subject to restrictions and delays on the part of the network providers affected.

7.4 Disruptions and Damages - If the customer causes damages or disruptions of the website or our delivery system by bad intent, he/she becomes liable for all direct and indirect consequences and associated costs.

7.5 Message Content - The customer assumes full responsibility for the content of the messages transmitted by herself or by a third party on her request. The customer agrees to abide to all laws and regulations applicable to the content and intent of the messages transmitted by her. The customer assumes liability for all consequences and costs arising out of offenses against such regulations. The customer must ensure that her message delivery does not cause disturbance or harassment of a recipient or other third party. The customer agrees to refrain from sending messages containing offensive, violent, pornographic, or discriminatory, or otherwise illegal content. The customer is not permitted to send messages to recipients who have made clear that they do not wish to receive these messages or advertisements. The sender of such unsolicited messages (the Customer) bears full legal and financial responsibility for such actions. PrimeContact. shall not be liable for any damages arising out of or in any way connected with the use of the website by such Customers.

8. Applicable Law You agree that all disputes, claims or other matters arising from your use of the Site will be governed by the laws of Canada and the federal laws of US. You also agree that all Claims will be heard and resolved in a court located in the province of Ontario Canada.

9. Termination/Modification of License We reserve the right, without notice and in our discretion, without any liability to you, to terminate or limit your license and/or access to use the website, or any services provided by us.

10. Inactive Accounts; Termination of Agreement If your subscription payment has been canceled, rejected, not cleared or not received on time, we may deactivate and/or delete your account without any notice. All your data will be lost. You and PrimeContact. may terminate these Terms and your use of the Site and Services at any time. Purchased message credits and other fees are not refundable or transferable and do not bear interest. In case of account/program cancellation by the customer, unused credits will expire immediately.

  • Polling

    Our firm specializes in two distinct types of polling and research services on behalf of government: Public Opinion Telephone Surveys using Live Agents and Public Opinion Telephone Surveys using our Automated IVR platform.

    Using Live Callers - These calls are made by our professional team of survey takers, expertly trained in conducting all types of survey research polls.

    Automated IVR Polling - These polls use Automated IVR Surveys to allow respondents to respond to a pre-recorded series of questions by touching their telephone key pads to register their answers. This form of surveying can be extremely cost effective and quick to deploy.

    Advantages of Automated Surveys:
    - Inexpensive compared to Live Agent Telephone Surveys.
    - Able to obtain very large sample sizes (larger sample sizes decrease margin of error and increase confidence in statistical results)
    - Rapidly deployable.
    - Respondents hear the exact same pre-recorded questions which reduces the potential for bias arising from human agents.
    - Respondents may be more “honest” when dealing with a machine versus Live Agent.

    Advantages of Live Agent Telephone Surveys:
    - Know exactly who is answering the survey.
    - Trained agents can more effectively interpret and solicit responses.

  • Baseline

    A baseline poll is a detailed survey of to gauge the feeling, sentiments and major issues that matter to your audience. It develops a detailed breakdown of your strengths, weaknesses, issues, messages and opponent(s). From this information a campaign road map can be developed to plan every step and target your messaging. A baseline poll should be as possible to ensure you are armed with the details you need to win a campaign.

    Overview and Process

    This poll would be conducted by phone from our Research Call Centre. It would be made up of many closed-ended questions and a few open-ended issue based questions. These questions would be tailored to your needs. Our Research Firm would develop a scientifically accurate random sample of voters from your area.

  • Resonance

    Trend polls are conducted within the context of your active campaign. This will help determine that your messaging is being absorbed by the sampled universe and it serves as a progress chart of your campaign.

    Often a trend poll will discover holes in your messaging and can determine whether strategic or tactical changes are needed. It may also serve as an indicator of changing dynamics in your campaign. This form of polling is recommended after your campaign communicates by mail, debates, media, or mass canvass. Campaigns that are the first to notice the changes and possible issues with their internal messaging will have a strategic advantage.

    Trend-based polling is also the ideal platform to incorporate issues that may be gaining momentum on the campaign trail. Often voting issues change as the campaign enters the writ period; what may have ranked as a mid-level issue can quickly climb to the top. This is often caused by increased discussion and policy that may be disseminated by other candidates or from your own platform. History reveals many examples of campaigns that championed the wrong issues without properly polling the electorate. More often than not, this will result in a slide in popularity and ultimately a loss. Campaigns that monitor issues throughout an election are able to spot these trends early and alter their messaging appropriately.

  • Tracking Intelligence

    Tracking polls are short polls designed to help you manoeuvre your campaign through the final stretch. These polls provide information vital to the refinement of your strategy and tactics. Your field coordinators will use tracking polls to adjust plans and assignments accordingly and your media team will use them to alter television and radio rotations or adjust mail targeting. They are not intended for the development of completely new plans, strategies, or tactics. Tracking polls enable your campaign to see a snapshot of the electorate. This will help you determine whether your momentum is building, stalling, or slipping.

    Tracking polls are often deployed after debates, prior to and immediately after advance polls, and in the final fourteen days of the campaign.

    Our Research Firm always recommends having strategies in place in case the intelligence you receive is not in your favour. In the event polling shows a decline in support, solid strategies must be executed immediately. Polling which reflects negative results in the final stretch of an election may cause a deflation of morale in your candidate and campaign staff. It is suggested that such results are only discussed between the campaign manager and the Research Firm so we can help guide your team through this turbulence.

  • Viability

    This poll determines a candidates viability prior to entering the race of before making major policy decisions. It is also used to determine the strengths/weaknesses of your opponent(s) at a vital stage. The information gathered from this poll, will serve as your campaign's Launchpad and help you navigate through the first weeks of your campaign.

    Viability Survey

    These surveys are also best suited to help potential candidates determine if the seat is winnable and the popularity of both themselves and other candidates who may consider running. Since questions are often based on calculated speculation, we put more emphasis on the cross tabulation of results to show how voters' intentions would differ if their first choice candidate were to drop out or decide not to run.

    Bench Viability

    These preliminary polls are a combination of the baseline poll and the viability poll to provide you with comprehensive information on your candidate's strengths and weaknesses, your opponent's strengths and weaknesses, issues, messages, and potential messages. These surveys also address the campaign's starting point and may identify key issues. A bench viability poll will provide you with the insights for a strong foundation upon with you can build your campaign.

  • Focus Groups

    Our Research Firm will pull your vote the right way. Our Live Agent Campaign Callers will call through your lists delivering crucial Election Day reminders and thereby ensuring your voters know where to vote, and understand the importance of casting their ballot.

    If your voter needs directions to the poll, we can email them a map and driving directions or verbally instruct them as to the best route to take to the polling location. We also take ride requests that can be accessed in real time on our E-Day Client Interface.
